Privacy legislation (GDPR/RGPD)

The General Data Protection Regulation (GDPR) has been in force since 25 May 2018. This new regulation, known in French as the “Règlement général sur la protection des données” (RGPD), applies throughout the European Union and mainly concerns the retention and protection of personal data.

What is personal data?

Certain types of data reveal something about you, such as your name, address or age. If this data (or combination of data) can be linked to you, it is known as personal data. Examples include your postal or e-mail address, as well as your first name combined with your date of birth. If third parties gain possession of this personal data, they must handle it with care. A photo or video can also be considered as personal data.

Where does the personal data come from, which is processed by Jermayo nv?

Jermayo nv only processes personal data from persons, with whom we have, wish to have or have had a direct or indirect relationship. This includes, for example, data concerning:

For which purpose is personal data processed by Jermayo nv?

It is mainly used for purely practical purposes, including all kinds of administrative processes linked to invoicing, offers, etc. If you enter into contact with us using a form on the website, we need your personal data so that we can get back in touch with you.

Data can also be used for promotional or marketing purposes, such as telling you about new projects or sending you information of a general nature. What if you do not wish to receive any information from us? You only have to click “Unsubscribe” in the e-mail that you have received. Your e-mail address will then be deleted and you will no longer receive any automatic e-mails from us until you re-subscribe.

If you apply for a job, you are personally responsible for the content of your CV and application letter that you will be asked to provide.

Is unique personal data also processed by Jermayo nv?

Unique personal data refers to sensitive data, such as information concerning a person’s health, criminal record, ethnic origin or race. We only process unique personal data if it is legally required, with your consent or if you ask us to do so. In the latter case, we only process this data if it is necessary in order to provide our service.

Who can access my personal data?

At Jermayo nv, your personal data can only be consulted by Jermayo nv employees.
Jermayo nv cannot exchange data with third parties without the express consent of the relevant persons. Contact us at jermayo@jermayo.be to ask for an overview of all the personal data that we process, which concerns you. Your personal data is stored carefully and is not processed for longer than necessary for normal use. We can make changes at your request (for example, change of address). If e-mails are exchanged using forms on our website, it is possible that the site developer may monitor them for statistical and technical purposes. In this context, no data is retained for future use and data is only used to ensure that the relevant forms are working properly.

How long will my data be stored?

Data linked to customers is kept for as long as necessary, so that administrative or accounting tasks can be completed. Data obtained using a form on this website is stored for as long as it is required for the relevant communication.

If you unsubscribe from the newsletters (for example, using MailChimp), e-mail addresses will be kept in limited form, so that statistical information can still be generated, such as the number of subscriptions over the years. No more e-mails will be sent to you automatically without your prior authorisation.

Data will be stored either internally, on secure computers, or on web servers at Combell (www.combell.be), with access being protected by Combell.

Can I see which data concerning me is processed by Jermayo nv?

Of course! Contact us at jermayo@jermayo.be and ask us to send you all your data. We will reply as quickly as possible. If you wish, you can ask for changes to be made or for all your data to be deleted.

Any data that you provide will remain in the European Union and is fully covered by the legal requirements of the GDPR.

Who can I contact if I have a question or complaint?

For any questions or complaints regarding the processing of personal data by Jermayo nv, or if you would like an overview of the available information or possibly wish to have it changed or deleted, you can simply contact us at jermayo@jermayo.be. If you feel that your data has been misused, you can also contact the Privacy Commission.

In practical terms, what does Jermayo do with my data?

Jermayo will ask for your details in 3 situations:

(1) General contact form: in this case, we will ask for your name and e-mail address. We need this information so that we can contact you. You also have the option of adding a message, in which you can write your question or comments. This data is stored until the end of the necessary communication, in order to follow up your request.
(2) Download form: for statistical processing we ask you for your name and email address before the download can start. Your data can be used in a list of potential interested clients, but will never be used for a mailing campaign without your written consent.
(3) Application form: we need your name and e-mail address so that we can contact you. We will also ask for your CV and an application letter, in order to make an initial selection as part of the recruitment process. This data may be stored in order to prepare an in-house recruitment list, which may later be consulted by Jermayo, if it is found that additional employees are required.
(4) Promotions: With certain promotions, we will ask for your contact details (e.g. name, e-mail address) to be able to easily inform you in the future about this promotion. If you are a professional customer, we may ask you to give us your VAT number. These data are saved in a CRM program for statistical means.

To prevent misuse, your IP address and the time of transmission will be added to every message we receive from the website.

Opt-out and right to be forgotten

Jermayo nv may send you (automatic) messages, such as an acknowledgement following an enquiry or application, or an automatic reply if an employee is absent. It is not possible to unsubscribe from these service messages. Jermayo nv considers them essential for a good user experience.

If you would like us to delete all the data that we have about you, please send a request to jermayo@jermayo.be. We will try to reply to your request as quickly as possible, while taking account of all the legal and accounting requirements.

For other messages, you have the option of unsubscribing by means of an OPT-OUT included in each e-mail. All automatic messages will include an “Unsubscribe” link. If this is exceptionally not the case, you can always let us know at jermayo@jermayo.be.
